By submitting an application for membership or confirming renewal of
membership you agree that you have read, understood and agree to the
IFMT Membership Rules as outlined below:
1.1) Qualification for Membership
Applicants may apply for membership to the Irish Federation of
Master Tradesmen if:
A) he/she and his/her employees have the necessary skill to render
the service and will carry out the service with due skill, care and
diligence.
B) he/she and his/her employees ensure that the materials necessary
to render the service are sound and reasonably fit for the purpose
for which they are required.
C) he/she has adequate Public Liability Insurance and Employers
Liability Insurance (where applicable)
D) he/she and his/her employees agrees to work to the IFMT Code of
Practice and to at all times demonstrate a high standard of
workmanship and quality of service.
E) he/she can provide at least two genuine references from previous
customers in the last 12 months.
F) he/she agrees to cooperate in a timely fashion in the event of a
complaint/dispute.
1.2) Providing references
Applicants are reminded of their obligation to comply with paragraph
(1.1) (e) and to provide the full contact details including postal
address of genuine referees.
The IFMT reserves the right to cancel membership in the event that
it is bought to our attention that any of the references supplied to
us were not genuine or authentic.
If an applicant provides the details of a referee who has previously
made an application for membership which has been rejected or who
has their membership cancelled you will be required to provide the
details of an alternative referee. This will not affect our
decision.
Applicants agree to provide a further 2 references upon annual
renewal of membership.
2) Membership Application Decisions
The IFMT reserves the right to reject an application for membership
and in such cases the applicant will be informed in writing of the
reasons for our decision.
Applicants will be entitled to appeal against our decision within 30
days of date of notification.
3) Membership Certificates and
Membership Logos
All IFMT members are entitled to a certificate of membership upon payment of all fee's due. Members are also
entitled to receive two IFMT Membership vehicle logos. Additional
logo's can be ordered and are charged per unit accordingly. In addition
members are entitled to use an IFMT Member logo in graphic format on
any promotional or advertising material or advertise any words that
imply affiliation to the Irish Federation of Master Tradesmen. IFMT
Member logo's are available to members upon payment of all fee's due
and must not be edited or distributed in any way.
Every membership certificate, vehicle logo and any other IFMT member
logo or merchandise remain the property of the IFMT and shall be
returned immediately to the IFMT upon cancellation of membership or
removal from our database. In the event that a member makes an
appeal in writing against a decision to cancel membership then the
membership certificate, vehicle logo and other merchandise may be
retained until a final decision has been reached.
Non IFMT Members and website owners are permitted to use the
standard IFMT logo in graphic format or hypertext link for use on
any website for the purpose of reciprocal linking or advertising
purposes so long as IFMT Membership is not implied. All website
logo's remain the property of the IFMT and the IFMT reserves the
right to request the immediate removal at its discretion.
4) Renewal of IFMT Membership
IFMT membership is effective from the date of approval of membership
application and for the duration of 12 months unless membership for
whatever reason is cancelled or you are removed from our database.
Registration is continued on an annual basis and subject to
compliance with the code of practice in force at the time of re
registration and compliance with the IFMT Membership Rules as set
out in paragraphs (1.1) (a) through to (f). In addition you must
supply the details of a further 2 referees for whom you have carried
out work in the last 12 months or since your last registration as
stated in paragraph 1.2.
All members will be advised in writing 30 days prior to the date
that annual renewal of membership is due. Continued registration
must be confirmed within 14 days of the required date for re
registration along with the details of a further 2 referees.
In the event of non compliance with any of the rules of IFMT
membership as set out in paragraph (1.1) (a) through to (f) the IFMT
reserves the right to suspend membership and any certificates of
membership, vehicle logo's or any other merchandise which implies
IFMT Membership must be returned immediately.
Members have the right to choose not to renew their IFMT Membership.
In this instance this must be confirmed in writing and received by
us no later than the date that re registration is due.
5) Membership Fee's and Renewal Fee's
Payment of membership fee's must be paid in full before your
application can be processed and accepted. In addition you must also
provide the details of 2 recent references.
When your membership is due for renewal
we will automatically contact you 30 days prior to the renewal date.
Renewal fee's must be paid in full no later than 45 days from the
date that re registration is due. If you do not wish to renew your
membership you must let us know in writing. The IFMT reserves the right to
temporarily suspend you from its register and website database until
such time as your renewal fee has been paid.
6) Change of Details
All members must inform the IFMT within 30 days of any change in the
details contained in first membership application:
A) Company or Business status (including ownership)
B) Major changes in the type of services offered
C) Address
D) Telephone, Fax or Mobile Telephone number
E) Email address
F) Website Address
G) If you cease to carry out business.
Failure to inform the IFMT of any such changes may result in
cancellation of membership.
7) Cancellation or Suspension of
Membership.
The IFMT reserves the right the cancel membership with immediate
affect if:
A) It is bought to our attention that any references obtained where
not authentic.
B) Any information supplied on a membership application form is
false or misleading.
c) The IFMT is satisfied after any investigation whether internal or
external that a member has acted in anyway that might bring the IFMT
and its fellow members into disrepute.
D) The IFMT is satisfied after any investigation whether internal or
external that a member has failed to comply with membership rules or
the code of practice in force at the time of first membership or re
registration.
E) Where a member does not cooperate in a timely manner regarding
any internal dispute or complaint that is made to us which warrants
further investigation.
F) Failure to inform the IFMT of any changes in details as set out
in paragraph (6.) (a) through to (g).
8) Internal Complaints
Complaints lodged against members must be in writing and received by
us within 30 days from the date of alleged breach of IFMT Membership
Rules. A notice of the complaint will be sent to the member
concerned within 14 days of receipt of complaint. In accordance with
paragraph (1) (f) the member must cooperate with any complaints made
against them and respond to the notice of complaint in a timely
manner and in no later than 30 days from date of notice of complaint
with an explanation or defence. A copy of the member's response
including any explanation, defence and/or offer of resolution will
be sent to the complainant within 7 days of receipt. Where an offer
of resolution has been made by the member and accepted by the complainant then no
further action will be taken. In the case where a
resolution cannot be found or does not satisfy both parties then the IFMT will mediate between both parties to find a suitable
resolution. If the IFMT is satisfied after any internal
investigation whether a resolution has been found or not that a
member has seriously breached the rules of IFMT membership, failed to
comply with the code of practice in force at the time of first
membership or re registration or has acted in a way that will bring
that the IFMT and its fellow members into disrepute then IFMT membership will be cancelled
with immediate affect.
9) Appeals
Appeals
against decisions under Rules 2, 7 and/or Rule 8 must be made in
writing and sent by registered post within
30 days from the date of written notification of our decision and
must be accompanied by the deposit of €200.00
which will be refunded in the event of the appeal being successful.
The Appeal shall be heard within 30 days of the notice of appeal and
shall be decided by a Tribunal of four nominated
persons not members of the board of the IFMT. Additional evidence or
defence may be supplied before the date of
appeal so long as it received within 10 days prior to the date of
hearing of the appeal.
The decision of the Tribunal shall be final and shall be notified to
both parties concerned by Registered Post
within 14 days of decision. The rights and benefits of membership of
the Registered Member will not be withdrawn while the
Appeal is pending.
10) Return of Membership Certificates
and Vehicle Logo's
Where membership has been cancelled or re registration has been
declined and an appeal has not been made within 30
days the tradesman must return his/her
certificate membership and remove and dispose of
his/her membership vehicle logo. In addition any reference to IFMT
Affiliation must be removed from any correspondence or advertising material and shall not in any way
imply affiliation to the IFMT.
11) Publication of Cancellation of
Registration
From time to time the IFMT may, at its discretion, make public
details of declined applications and cancelled
memberships. |
